This book seeks to reframe the normative narrative of the 'culpable person' in American criminal law through a more humanising lens. It embraces such reframed narrative to revise the criteria of the current voluntarist architecture of culpability and advance a paradigm of punishment that positions social rehabilitation as its core principle. The book constructs this narrative by considering behavioural and neuroscientific insights into the functions of emotions, and socio-environmental factors within moral behaviour in social settings. Hence, it suggests culpability notions that reflect a more contextualised view of human conduct, and argues that such revised notions are better suited to the principle of personal guilt. Furthermore, it suggests a model of 'punishment' that values the dynamic power of change of individuals, and acknowledges the importance of social relationships and positive environments to foster patterns of social (re)integration. Ultimately, this book argues that the potential adoption of the proposed models of culpability and punishment, which view people through a more comprehensive lens, may be a key factor for turning criminal justice into a less punitive, more inclusionary and non-stigmatising system.

This book theorises and concretises the idea of 'absolute rights' in human rights law with a focus on Article 3 of the European Convention on Human Rights (ECHR). It unpacks how we might understand what an 'absolute right' in human rights law is and draws out how such a right's delimitation may remain faithful to its absolute character. Concretising these starting points, it considers how, as a matter of principle, the right not to be subjected to torture or inhuman or degrading treatment or punishment enshrined in Article 3 ECHR is and ought to be substantively delimited by the European Court of Human Rights (ECtHR). Focusing on the wrongs at issue, this analysis touches both on the core of the right and on what some might consider to lie at the right's 'fringes': from the aggravated wrong of torture, to the severity assessment delineating inhumanity and degradation; the justified use of force and its implications for absoluteness; the delimitation of positive obligations to protect from ill-treatment; and the duty not to expel persons to places where they face a real risk of torture, inhumanity or degradation. Few legal standards carry the simultaneous significance and contestation surrounding this right. This book seeks to contribute fruitfully to efforts to counter a proliferation of attempts to dispute, circumvent or dilute the absolute character of the right not to be subjected to torture or inhuman or degrading treatment or punishment, and offer the groundwork for transparently and coherently (re)interpreting the right's contours in line with its absolute character.

This book presents the fundamentals of crystalline shape memory materials and structures made thereof, focusing attention on models useful from the viewpoint of structural analysis and their numerical realization. The book is a self-contained presentation of parts of this intriguing subject and is useful as an introduction to newcomers to the field. It is split in four parts. The first part describes the basic concepts of continuum mechanics and thermodynamics as well as the mathematical notions and computational techniques which are applied in the sequel. Part two is concerned with the mechanical behavior of structural elements within the range of elasticity. Herein the finite element method is presented in detail for structural boundary value problems and its approximation properties are illustrated. After these preliminaries, the shape-memory materials are considered and various theoretical models are developed that take in account the characteristic pseudoelastic hysteretic loops. Part four presents the behavior of various structures (trusses, rods, beams, disks, plates) made of shape-memory materials. The book deals both with the modeling of continuum and structural mechanics problems and the aspects of their computer implementation, and includes many numerical examples that demonstrate the application of the methodologies described. It introduces modern modeling techniques and shows how these techniques can be implemented in computational mechanics of real-world problems.
